U.S. Department of Transportation's environmental streamlining efforts as directed by TEA-21 focus on improving the environmental review process for transportation projects by reducing delays and improving the integration of project development and NEPA, while protecting and enhancing the environment. This guidance presents strategies for interagency collaborative problem solving by identifying issues that may arise during the transportation project development and environmental process reviews under the National Environmental Policy Act (NEPA) and related laws. The guidance covers interest based negotiating and assisted and unassisted conflict management and dispute resolution processes. These strategies should help Federal and state transportation and resource agencies to implement a coordinated environmental review process that reduces delays for highway and transit projects. This guidance offers options for problem solving; it is not intended to be prescriptive.
This guidance is one element of FHWA's National Dispute Resolution System. The other elements are specific elevation procedures to the Secretary of Transportation, a roster of qualified neutral facilitators, and workshops in the application and use of alternative dispute resolution during project development. Facilitated interagency workshops will be held in each of the ten standard Federal regions. These customized workshops, currently under development, are anticipated to begin in late Spring 2003 and will use this guidance as the principal reference document.
This guidance and the associated workshops have been developed in collaboration with the U.S. Institute for Environmental Conflict Resolution and in cooperation with the Federal Transit Administration and the non-transportation Federal agencies that signed the national environmental streamlining memorandum of understanding.
